Agreement to Terms

By downloading, installing, or using What's Good For Tonight ("the App"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not use the App.

Description of Service

What's Good For Tonight is a mobile application that provides:

Room-based group planning with a shareable 6-character invite code
A vibe slider to set the group's desired atmosphere (Chill to Crazy Night Out)
AI-powered activity and venue suggestions tailored to your group's preferences
Real-time voting so every member can weigh in on suggestions
Pre-event activity recommendations to kick off the night
Room sharing via QR code and deep link
Optional public rooms that a host can make discoverable to nearby users for open joining
In-app advertising through Google AdMob

Subscriptions and In-App Purchases

The App may offer subscriptions and in-app purchases ("Digital Purchases").

Subscription Terms

Payments will be charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel subscriptions in your Apple ID account settings after purchase.

Free Trials

If a free trial is offered:

Any unused portion of a free trial period may be forfeited upon purchasing a subscription.
After the trial ends, the subscription automatically renews unless cancelled before renewal.

Pricing

Subscription prices and features may change at any time. Changes will not affect already-paid subscription periods.

Refunds

All purchases are processed by Apple. Refund requests must be submitted directly to Apple and are governed by Apple's policies.

User Accounts

Registration

No registration is required. The App uses a device-based identifier stored in your Keychain to associate you with room sessions.

Data Removal

Room data is automatically deleted from our servers after 6 hours. Uninstalling the App removes your local device identifier.

Acceptable Use

You Agree To:

Use the App in compliance with all applicable laws
Provide accurate preference information so AI suggestions are relevant to the group
Respect other room members and their preferences
Behave respectfully toward others in public rooms, and not harass, spam, or post offensive or inappropriate content

Prohibited Activities:

Using the App to facilitate illegal activities
Attempting to reverse engineer, hack, or disrupt the App or its backend
Manipulating room sessions or voting in bad faith
Harassing, abusing, or disrupting other participants in public rooms

We may remove or restrict access for any user who abuses public rooms or otherwise violates these terms.

Public Rooms

Rooms are private by default. A host may choose to make a room public, which makes it discoverable to nearby users so they can join without an invite.
Making a room public exposes the room and the display names and preferences of its participants to nearby users who discover and join it. Room visibility is controlled solely by the host.
When you use public room discovery, your device sends its location to our servers. We filter public rooms by distance on the server and round (coarsen) coordinates before sharing them, so exact host or participant locations are not broadcast to other users.
Hosts are responsible for their decision to make a room public and for the information shared within it. We do not control, screen, or approve who joins a public room and are not liable for the conduct of participants who join.
Public rooms are temporary and follow the same automatic deletion after 6 hours as all other rooms.

Intellectual Property

The App and its content are owned by Whispering Apps
You receive a limited, non-exclusive licence to use the App
You may not copy, modify, or distribute the App

Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect and use your data.

Advertising

The App may display ads provided by Google AdMob. Ad availability, format, and personalisation may vary based on your region, consent choices, device settings, and Google's advertising policies. You agree not to manipulate, fraudulently interact with, or interfere with ads shown in the App.

AI-Generated Suggestions

Suggestions provided by the App are generated by AI and are for informational and entertainment purposes only. We do not guarantee the accuracy, availability, or suitability of any suggested venue or activity. Always verify details directly with the venue.

Limitation of Liability

To the maximum extent permitted by law:

The App is provided "as is" without warranties
We are not liable for any indirect, incidental, or consequential damages
Our total liability shall not exceed the amount you paid for the App

Indemnification

You agree to indemnify Whispering Apps against any claims arising from your use of the App or violation of these terms.

Changes to Terms

We may modify these terms at any time. Continued use after changes constitutes acceptance of new terms.

Governing Law

These terms are governed by the laws of the State of Hamburg, DE.
